Recall the Entire Senate.

I'm not sure how everyone else feels about the situation with the senate, but the basic background is as follows:
1. Elections were held for fall elections to replace current senators since their terms are ending
2. The election process happens people sign disclosure forms for academic status spending monetarily and conduct during elections (binding legal contracts)
3. It is known only later that some candidates cannot run due to their violation of such contracts.
4. Investigation is held
5. The elections being over and the votes counted the Senate Suspends their bylaws (thus erasing rules of elections and disciplinary courts ect)
6. New seated senate, was seated by old senate, possible cronyism stated.

The senate is supposedly the representative body of the students regardless of your voting status (add more if you wish). You should feel angry that the Senate once again let crooks in regardless of standing written contract. The question at hand is: should we allow thieves, (convicted or otherwise for more info type in daviswiki 'Ackerman book scandal') elitists (see swords and sandals) and scoundrels in the senate?

You should feel angry that the people you elected are not trustworthy or that they control a budget of nearly TEN MILLION dollars, which they will be wasting on, pet projects that do not directly effect or do anything for the common student. The UC Davis Associated students has the dubious honor of having the highest student fees for services that we use every day such as the bus service, the MU, Tipsy taxi, The ARC just to name a few. We stand proud as a student body to strive to make the community at UC Davis stronger and more competitive may it be Sports, Academics including the Greek Community within the school.

Should we allow the student senate the standard of our own democratically elected legislature to unduly provide cronyism and bribes to communities that benefit no one except those who already hold the purse strings to our student budget. If you had read this far maybe you care a little but here are a few reasons you should care about these scandals.

1. The associated students senate is sole representative body of the students universally and are held to represent us in university matters as well as those in the community.
2. Elections should be held in a fair and free way (this standing senate was allowed to be seated even though some of those elected were implicated.

3. Assuming the above is true should we hold the senators to a higher standard?

I say yes to this. How hard is it really to get a C in a class? In certain classes it is very hard in others very easy the point is that we all came to UC Davis due to our high achievements in academics sports and community service, it is not too much to ask that our elected student body have a standard which is a 2.0 GPA to stand for election. Also it is not too much to ask our representatives to be honest about their academic background we are not asking the full disclosure of grades but rather a passing grade so we have confidence that they can continue their work for us as well as continue in the university.

It is also a shame to see how corrupt the system of check and balances is, how can we let the senate consciously suspend the constitution to seat the friends of the current senators? It is like asking the senators to appoint to appoint their friends not those who should have been elected. The indignity that the associated students have had in the last couple of years with scandals coming from the elected branches is scary. I say recall the whole lot of the senate and start new. We may have a short memory of scandals but let us not forget this one sign the petitions start a petition demand that the senators resign or recalled. We do not deserve this every single election lets start new with a completely new senate so the same does not happen again.

Agreed! You need 1/4 of registered students signatures to have a recall election. With around 20,000 undergraduates, that's a little over 5,000 signatures needed. Not impossible, but if you want to do it you'll need to start organizing. Let's do it!

I believe that it is 8%, so just less than the # of people who voted in the last election. You can pick up forms and have the processed clarified on the 3rd floor of the MU, Student Government Administrative Office (SGAO).

Signatures are really easy to get as long as you are organized and don't have multiple people trying to get signatures for the same thing and doing unnecessary double duty.

1) if you have these views, you should be running for senate yourself.
2) it should be noted that the senate actually didn't suspend their bylaws. They wrote legislation to correct the problem. They fixed it the way they fix any problem: they write a bill amending their codes.
3) the Senate, in the words of Rob Roy, was "Damned if [they] do and damned if [they] don't."
4) it should also be noted that a large chunk of the ASUCD budget goes towards things like the CoHo, Unitrans, and Tipsy Taxi, to name a few.
5) "provide cronyism and bribes" Yeah, they are guilty as charged. however, the people doing the "bribing" are students who want their campus life improved. If Senators don't want to do that, then they wouldn't have run in the first place.
6) "...to communities that benefit no one except those who already hold the purse strings to our student budget." What specific ASUCD unit are you referring to? Have you even read through the budget?
7) The court case only dealt with the elections committee, not the individual candidates. this is why the candidates not under question could not be seated.
8) THe office of External Affairs actually does a lot more hands on stuff in the community and is more responsible for how we look to the community.
9) you obviously don't know the circumstances of the infractions if you think that any of the candidates didn't get a 2.0. In short: learn your facts, then argue.
10) again, the senate did not suspend the constitution nor its bylaws. and i don't think the checks and balances system worked inappropriately. The court was not able to do anything. So the Senate, in concurrence with the President, wrote legislation to fix the problem. And if you were at the meeting, which I doubt you were, you would know that the Senators were legitimately interested in what is best for the students. (And if you're refering to appointments for legitimate vacancies in your statement "to appoint their friends not those who should have been elected," that issue WAS taken care of in the constitutional amendment that the voters passed in this last election. Way to pay attention to your votes.)
11) Welcome to the real world. Things will fuck up. Don't think that recalling all of the Senators, most of whom have done incredible work over the last few quarters, will make everything all better. It will only slow down the governmental process, which is already slow as it is. It will also mean that fewer helpful programs will be moved forward. And you're looking out for the best interests of the students, right?

note... as to point 7- although the defendant was john leathers of the elections committee, the real parties to the case were in deed the two senators

Actually, after they wrote the bill they still had to suspend the bylaws because they didn't change enough in the retroactive bill.

The Coffee house is actually a self sufficient unit as is unitrans they only get free rent for the building otherwise they could afford being self sufficient

In reply to the 8 and 11 you're right the ASUCD doesn't handle things in the community the external affais do but in the real world if you violate election law this blatently you get ARRESTED.

1. I have run before so don't call me the coward you are by stating the these facts anonymously or should I say ip address 24.10.39.242

2. Writing legislation the is unconstiutional by rejecting legal contract is wrong in and sense of the matter

3. By qouting rob roy you are indeed using a logical falicy of justification through power

5. That is the point you cannot run as a senator if you did not sign your disclosure aggrements (I was on the election committee before)

7. As stated above the senators in question are in the question of the hour. Did they not get certified by the elections committee?

8. The external affairs does more things with the community yes but the senators are the outside face of those memeber who are appointed by the senate

Not that I don't agree with you, but please check your facts first. These senators were not removed due to a low GPA, they were on disciplinary probation from Student Judicial Affairs.

Not all of the senators should be persecuted. I'm awfully happy Kristen Birdsall was able to get the book list going last quarter, and I know that has been very useful. I do agree that the whole situation seems quite shady, and something should be done to keep some kind of legit faith in the ASUCD. There have been many scandels and a low voter turn out for a while, they should make a greater effort to keep the student body interested and on their side.

to current senators

I know this situation would disrespect current senators and I do not mean any disrespect. Although this situation has to be handled with much care it can be said that this situation was handled stupidly. I respect the rule of law rule of law (in this case Assocaited Student Constitution) and by allowing the current senate to be seated without the a proper hearing was unconstitutional and should not be tolerated. I say we should have all affected parties either resign or be recalled.
